These General Conditions are supplemented by any specific conditions that may apply to certain products or services that TIPSTERVIP may offer to the USER at any time through the PLATFORMS (hereinafter, the “Specific Conditions” ).

2. PURPOSE AND DEFINITION OF THE SERVICES OFFERED

TIPSTERVIP main activity is the development and management of platforms through which sports betting information is offered, with the aim of obtaining and expanding user knowledge.

3. TERMS OF USE

By voluntarily registering on our platforms and creating a profile, the USER declares that he or she understands and accepts these General Conditions, the Privacy Policy, and the Cookie Policy.

4. USER ACCESS TO THE PLATFORMS

In order to be a USER of the PLATFORMS, it is an essential and indispensable requirement to meet the following requirements:

Be of legal age (have turned 18);

Fill in the required fields of the User Registration form with truthful information (email and USER name);

Accept these General Conditions;

Accept the Privacy Policy.

Accept the Cookie Policy.

4.1 TECHNICAL ACCESS REQUIREMENTS

To access the PLATFORMS, the USER must have Internet access, pay the applicable fees, if applicable, and have the necessary equipment and computer systems to connect to the Internet, including a suitable terminal (computer, telephone, etc.) and a modem or other similar access device; or have a mobile phone, tablet, or similar device with an Internet connection.

If, in order to correctly access and use certain content and services of the PLATFORMS, certain computer programs or other software elements must be downloaded onto the USER's equipment, said installation will be the responsibility of the USER, with TIPSTERVIP declining any liability that may arise from this.

4.2 USERNAME AND PASSWORD

The USER will have a username and password for which he/she will be responsible, and undertakes to use them diligently and confidentially.

The USER agrees to use his/her USER name and password in accordance with the following restrictions: Neither the USER name nor the password may be contrary to generally accepted ethics and good customs, nor may they infringe the rights to honor and the image of third parties, nor in any way infringe the industrial and intellectual property rights of third parties.

Both elements - username and password - are for the exclusive use of the USER who owns them and their custody and correct use are his or her sole responsibility.

TIPSTERVIP cannot guarantee the identity of USERS and assumes no responsibility for the use of a registered USER's identity by third parties.

The USER must immediately inform TIPSTERVIP of any theft, disclosure or loss of his/her USER name and/or password, by communicating it to the following email address: luismigl@tipstervip.com

4.3 LICENSE

TIPSTERVIP grants the USER a limited, non-exclusive, non-transferable license (without the right to sublicense) for remote access and use of the PLATFORMS. The USER's access to and use of the PLATFORMS shall be subject to compliance with the conditions set forth herein and any accompanying or supplementary documentation.

4.4 PLATFORM AVAILABILITY

TIPSTERVIP will use commercially reasonable efforts to maintain the availability and access to the PLATFORMS, subject to interruptions resulting from maintenance, repairs, and updates. To the extent possible, TIPSTERVIP will attempt to notify the USER, electronically through the Service, of any scheduled service suspensions. Notwithstanding the foregoing, TIPSTERVIP will not be responsible for any failures in the Service or any other problems related to interruptions in telecommunications networks or internet access providers, networks or servers, or other equipment or services outside of TIPSTERVIPs facilities or its control.

4.5 PROTECTION OF PERSONAL DATA

The USER will not provide any personally identifiable information relating to individual persons ("PII") in connection with their use of the services offered through the PLATFORMS, unless TIPSTERVIP expressly agrees to receive such information, and then only to the extent necessary in connection with the USER's use of the services. In such case, the parties will execute all necessary documents under applicable law. The USER will be responsible for any personally identifiable information they provide to TIPSTERVIP.

5. RIGHT OF WITHDRAWAL

In accordance with the deadlines and other requirements established in the regulations applicable at all times, the USER may withdraw from this contract without stating a reason, within a period of fourteen calendar days from the date of its conclusion. All this without any penalty for the USER. The USER may exercise their right of withdrawal by sending an email to the following address: luismigl@tipstervip.com

Once the withdrawal request has been received, TIPSTERVIP will analyze the content of the request and verify that the requirements for withdrawal have been met, in which case TIPSTERVIP will issue the corresponding refund.

Likewise, in the event that the USER contracts any of the products and services offered at any time by TIPSTERVIP through the PLATFORMS, additional withdrawal periods may apply in accordance with the regulations applicable to said products or services, as reflected in the corresponding Specific Conditions.

6. CONTENT AND RATES

Being a USER allows you to access certain free content found on the PLATFORMS.

Paid content is also available on the PLATFORMS. The terms of access and other requirements applicable to access and use of such content will be governed by the corresponding specific terms and conditions.

6.1 WARNING

Cancellation of the USER's account or the mere deletion of the mobile application from their device does not confirm or entail cancellation of the contracted service. Consequently, this does not relieve the USER from the obligation to continue paying for the service.

7. USER OBLIGATIONS

The USER is solely responsible for the correct access and use of his or her USER profile and any content that he or she may create on the PLATFORMS, subject to applicable law.

By accepting these General Conditions, the USER undertakes to comply with them and will be liable for any damages that may arise from non-compliance.

The USER undertakes, by way of example and not limitation, to:

Respect industrial and intellectual property rights, as well as the regulations governing the protection of personal data;

Do not alter the normal operation of the PLATFORMS by manipulating their functions;

Do not introduce malware into the PLATFORMS, harmful to TIPSTERVIP or to other USERS;

Do not carry out any advertising actions of any kind without the prior written consent of TIPSTERVIP.

If the USER considers that other USER(S) is/are violating the General Conditions, he/she may report it by sending an email to luismigl@tipstervip.com

TIPSTERVIP, after examining the facts reported by a USER, will take the appropriate measures, and may exercise the right to expel the USER under the terms provided in the following section of these General Conditions.

8. USER'S RIGHT OF EXCLUSION

TIPSTERVIP reserves the right to deny or withdraw access to the PLATFORMS and/or the services offered without prior notice, at its own request or that of third parties, to those USERS who fail to comply with these General Conditions of Use.

9. USER UNSUBSCRIPTION

The USER may at any time unsubscribe from the PLATFORMS by contacting the following email address luismigl@tipstervip.com

10. EXCLUSION OF LIABILITY

TIPSTERVIP is not liable for any damages of any kind that may be caused to the USER. This includes, but is not limited to: errors or omissions in the content, lack of availability or accessibility to the PLATFORMS, transmission of viruses or malicious or harmful programs in the content, despite having adopted all necessary technological measures to prevent them.

TIPSTERVIP is not responsible for the content provided by Tipsters on the PLATFORMS. TIPSTERVIP assumes no obligation to monitor such content and, consequently, does not guarantee the veracity, validity, and/or authenticity of the content provided by Tipsters .

TIPSTERVIP will not exercise any control or verification over sites and content of links or hyperlinks to other websites or PLATFORMS, so access to them is solely under the responsibility of the USER and said third parties. Consequently, TIPSTERVIP will not assume any responsibility for the content of links belonging to other websites or external PLATFORMS, nor will it guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, truthfulness, and validity of any material or information contained therein.

On the PLATFORMS, the USER may find various links that may lead to independent websites and applications outside of TIPSTERVIP.

TIPSTERVIP is not responsible for these links to other sites or web pages, as it has no control over them. Therefore, the USER accesses the content and the conditions of use that govern them under his or her sole responsibility.

Any bets placed by the USER are not placed on TIPSTERVIP platforms, which are intended to facilitate/offer predictions and opinions, to be voluntarily considered by the USER; rather, they are placed on platforms owned, operated, or operated by third parties to which they may be connected via links. TIPSTERVIP has no liability for these platforms. Their choice, operation, and access are the USER's free and voluntary decision.

Under no circumstances shall the parties be liable for any indirect, unforeseen, special, or incidental damages, including loss of profits, income, data, or use suffered by either party or a third party, even if the other party or any other person has been advised of the possibility of such damages. TIPSTERVIP shall be liable for damages caused by fault or negligence arising from its actions, with the corresponding compensation not exceeding, in any event, the amount corresponding to the price of the services paid by the USER to TIPSTERVIP at the time the cause giving rise to the compensation occurred. TIPSTER CHAT shall not be liable to the USER, among other assumptions, for the following: (i) in the event that the PLATFORMS are not used in accordance with the information and/or documentation provided to the USER by TIPSTER CHAT; (ii) in the event that the failure is caused by manipulations of the PLATFORMS not previously authorized by TIPSTERVIP or by third-party software.

11. INTELLECTUAL AND INDUSTRIAL PROPERTY

TIPSTERVIP, by itself or as an assignee, is the owner of all intellectual and industrial property rights of the PLATFORMS, as well as of the elements contained therein (including but not limited to: domain names and all those used to directly access the PLATFORMS) and their use corresponds exclusively to it, so the USER is obliged to respect them.

The content, text, images, designs, logos, images, sounds, animations, recordings, videos, computer programs, source codes, and, in general, any intellectual creation existing on the PLATFORMS; as well as the design and appearance of said PLATFORMS, as well as the site itself as a whole, as a multimedia work, are the exclusive property of TIPSTERVIP are protected as copyright by intellectual property legislation. The content also includes content created, where applicable, by the USERS themselves within the PLATFORMS.

The USER agrees that TIPSTERVIP is free to (i) collect, use, and create derivative works from data related to the use and performance of the services provided through the PLATFORMS; (ii) aggregate such data with other data to create compilations and analyses of such data ("Aggregated Data"); and (iii) use, copy, modify, create derivative works from, publish, and share such Aggregated Data in a manner that does not directly or indirectly identify USERS or any individual. TIPSTERVIP shall own all rights, titles, and interests in and to the Aggregated Data and any derivative works. In addition, TIPSTERVIP shall be free to reuse all general knowledge, experience, know-how, works, and technologies (including ideas, concepts, processes, and techniques) related to the Results or acquired during the provision of the services provided through the PLATFORMS (including, without limitation, those that it may have acquired by providing the same or similar services to other users).

ALL RELATED CONTENT IS PROPERTY OF TIPSTERVIP

Consequently, TIPSTERVIP holds the exclusive rights of reproduction, distribution, public communication, and transformation, as well as any other proprietary rights, over the elements indicated in this paragraph; all of this without prejudice to the moral rights of their authors.

The technological tools developed by TIPSTERVIP made available to the USER through this website are protected by intellectual property legislation and their use by the USER must be carried out exclusively in this area and without commercial purposes.

Pursuant to current intellectual property legislation, the following are expressly prohibited: the reproduction, distribution, and public communication, including making available, of all or part of the contents of the PLATFORMS, for commercial purposes, on any medium and by any technical means.

The USER undertakes not to delete, alter, circumvent or manipulate any protection device or security system installed on the PLATFORMS.

Any improper use by the USER of the intellectual and industrial property rights of the PLATFORMS in economic transactions will constitute a violation of the rights conferred by its registration and will be prosecuted by the means provided by law.

12. PROHIBITION OF WEB SCRAPING

USERS are expressly prohibited from directly or indirectly practicing or facilitating to third parties the practice or application of any computer technique of web scraping, crawling or similar practice that seeks to extract data from the PLATFORMS unless expressly authorized in writing by TIPSTERVIP.

13. UPDATE AND MODIFICATION OF THESE GENERAL CONDITIONS

These General Conditions may be modified for reasons such as changes in applicable legislation or to improve customer service, among others.

When any update/modification of these General Conditions occurs, TIPSTERVIP will notify you by the means of notification that TIPSTERVIP considers most appropriate, including, but not limited to: email to the address provided by the USER or notice on the PLATFORMS.

In such a case, the USER will be asked to accept the General Conditions again by clicking on the word YES or ACCEPT, selecting the corresponding box, or using a similar confirmation method.

If the changes made to the General Conditions are not expressly accepted again, the USER may not continue using the PLATFORMS.

14. EFFECTS OF THE NULLITY / INEFFECTIVENESS OF CLAUSES

In the event that any clause included in these General Conditions is declared totally or partially null or ineffective, said nullity/ineffectiveness will only affect said specific clause or the part thereof that is null or ineffective, so that these Conditions will remain in force in all other respects, limiting themselves to considering the parts declared null/ineffective for not being included.

15. LEGISLATION AND TERRITORIAL JURISDICTION – EXPRESS SUBMISSION

All relations between TIPSTERVIP and the USER are subject to Spanish law and the jurisdiction of the courts of Morelos to resolve any dispute between the parties, expressly waiving any other jurisdiction that may apply, provided that it is not imposed by legal imperative.
